Terms of Use

The terms that apply when you use EarthGuide3D.

These Terms of Use apply to EarthGuide3D for Mac and supplement Apple’s Standard Licensed Application End User License Agreement, which is incorporated here by reference. If these terms conflict with Apple’s Standard EULA, Apple’s terms control.

Purchases and Subscriptions

Current products, prices, durations, and usage allowances are displayed in EarthGuide3D and confirmed by the Mac App Store before purchase. Apple processes payment, renewal, cancellation, and refund requests.

  • Adventure Pass: a one-time consumable purchase. Unused time and teleports remain available and additional Adventure Pass purchases add to the existing balance.
  • Explorer and Worldwalker: auto-renewing monthly subscriptions. Each plan’s time and teleport allowances apply to the current subscription period and unused subscription allowances do not roll over.

Subscriptions renew unless canceled through your Apple Account at least 24 hours before the end of the current period. You can manage or cancel them in the App Store. Restores, renewals, refunds, and access remain subject to Apple’s transaction records and policies.

Online and Third-Party Services

EarthGuide3D relies on internet and third-party services for maps, imagery, place information, purchase verification, and optional AI guide features. Availability, coverage, accuracy, and response times can vary. Those services may change or become temporarily unavailable.

Map positions, place descriptions, narration, and AI-generated information are provided for exploration and general information. Do not rely on EarthGuide3D for navigation, emergencies, access rights, safety decisions, or professional advice.

Controller and Physical Safety

EarthGuide3D is a virtual world exploration experience, not a real-world navigation, sports training, stunt, survival, or safety simulator. Virtual terrain, heights, water, routes, landings, and movement do not show that a corresponding real-world action is safe, lawful, or accessible. Do not use the app to plan, learn, practice, or imitate real-world actions such as jumping or falling from heights, diving or entering water, climbing structures, crossing roads or railways, or entering restricted or private areas.

The browser controller operates over your local network and provides Cruise Mode and optional Sports Mode controls. Use a trusted private network or personal hotspot, keep the pairing QR code private, and remain aware of your physical surroundings. Do not use Cruise Mode, Sports Mode, or other movement features near traffic, stairs, water, obstacles, unsafe edges, or anywhere that requires your full attention. All users should stop using Cruise Mode or Sports Mode immediately if they feel dizzy, unwell, disoriented, uncomfortable, or unsafe.

Children should use EarthGuide3D with supervision appropriate to their age and ability. Cruise Mode, Sports Mode, and other movement-based features should be used by children only under the direct supervision of a parent, guardian, teacher, or other responsible adult, in a clear area away from traffic, stairs, water, obstacles, fragile objects, and unsafe edges.

Acceptable Use

Do not attempt to bypass purchase verification, usage limits, pairing protections, or safety controls; interfere with the service; obtain another user’s controller session; overload hosted services; or extract credentials.

Do not use Voice Go To, Ask the Guide, Audio Guide, or any other EarthGuide3D feature to seek, generate, facilitate, or promote sexually explicit or exploitative content; self-harm or suicide; violent wrongdoing; the acquisition, manufacture, or harmful use of weapons or explosives; illegal or recreational drugs; gambling; trafficking; extremist activity; or other unlawful, dangerous, or age-inappropriate conduct. Do not attempt to evade these restrictions through alternate wording, encoded requests, or manipulation of the app or third-party services.

Automated safeguards and third-party AI services may not identify every inappropriate request or result. Do not act on unsafe results. EarthGuide3D is not an emergency or safety service. Report inappropriate results to contact@earthrunner.org.
